These Terms of Use govern your use of the LongClarity application and related features and services.
1. About LongClarity and These Terms
LongClarity is a household retirement-planning and educational modeling application designed to help you explore how retirement assumptions and choices may affect your household's projected financial resources over time.
These Terms of Use govern your use of the LongClarity application and related features and services.
By downloading, accessing, or using LongClarity, you agree to these Terms of Use. If you do not agree to these Terms, you should not use LongClarity.
You must be at least 18 years old and legally capable of entering into these Terms to use LongClarity. The application may allow an adult user to include information about children or other dependents in a household retirement model, but that does not create an account for the dependent or authorize a child to accept these Terms.
LongClarity is currently designed for retirement planning in the United States. Its models incorporate concepts and assumptions relevant to the U.S. retirement system and are not designed to provide retirement projections for other countries.
Capitalized planning terms—including Starting Model, Current Plan, Proposed Plan, Modeled Lifestyle Spending, Healthcare, Estimated Federal Tax, Total Modeled Costs, Retirement Assets, Assets Outside of Retirement Accounts, Retirement Accounts, Asset Withdrawals, Funding Gap, and Modeled Funding Through—have the meanings explained in LongClarity's in-app glossary.
2. Educational Modeling; Not Professional Advice
LongClarity is an educational retirement-modeling tool. It allows you to explore hypothetical retirement scenarios based on information you provide and assumptions used by the application.
LongClarity's calculations, projections, charts, LongClarity Coach features, scenario comparisons, reports, and other outputs are provided for informational and educational purposes. They are not financial, investment, tax, accounting, legal, insurance, or other professional advice.
LongClarity does not create or provide a professional financial plan. LongClarity provides an educational retirement model designed to help you better understand your household's retirement assumptions, projected outcomes, and potential tradeoffs.
LongClarity does not recommend that you buy or sell any investment or financial product, select a particular investment strategy, take a particular tax position, or make any specific financial decision.
Retirement projections are estimates, not predictions or guarantees. Actual results may differ materially because of changes in investment returns, inflation, taxes, laws, Social Security or Medicare rules, healthcare costs, employment, spending, longevity, personal circumstances, and other factors.
Results also depend on the accuracy and completeness of the information and assumptions used in your plan.
LongClarity Coach and other scenario-modeling features may identify or compare hypothetical changes that could affect modeled outcomes. These scenarios are intended to help you understand tradeoffs and possibilities; they are not recommendations that you take a particular action.
Exploring a scenario does not automatically change your Current Plan. A proposed change becomes part of your Current Plan only when you deliberately review and adopt it.
You are responsible for deciding whether and how to act on information presented by LongClarity.
LongClarity encourages you to use what you learn as a starting point for your retirement-planning journey, including discussing your LongClarity results with appropriately qualified financial, tax, legal, insurance, or other professionals when appropriate.
You may share LongClarity reports and modeled results with professionals you choose to consult. Those professionals are responsible for their own advice, recommendations, and services.
3. Model Assumptions and Limitations
LongClarity uses mathematical models and assumptions to estimate how a household's financial resources may change over time. These models necessarily simplify real-world retirement planning.
Many assumptions used in your LongClarity plan are entered or selected by you and can be adjusted to explore different retirement scenarios. These may include retirement timing, Modeled Lifestyle Spending, Healthcare, Workplace Retirement Contributions, Additional Savings & Investing, Social Security claiming age, pension income, investment returns, inflation, Planned Spending Changes, and other household circumstances.
LongClarity may also use built-in assumptions or calculation methods where necessary to perform the retirement model. These may include assumptions or simplified calculations involving taxes, Social Security, healthcare, required minimum distributions, longevity, and other aspects of the projection.
LongClarity may use publicly available information, government data, third-party or industry data, generalized planning benchmarks, and other model assumptions as inputs to its retirement modeling. This information may change over time and may be incomplete, approximate, or based on generalized populations or circumstances. It is used as a planning input and does not guarantee your actual future costs, benefits, eligibility, tax results, or other outcomes.
You control the assumptions that LongClarity makes available for you to enter or adjust. Changing those assumptions may materially change the modeled results.
LongClarity's modeled results depend substantially on the information and assumptions you provide. You are responsible for the accuracy, completeness, and reasonableness of the information and assumptions you enter or select.
LongClarity does not independently verify the financial, household, benefit, spending, asset, income, or other information you provide.
If information or assumptions you provide are inaccurate, incomplete, outdated, or hypothetical, the resulting projections may also be inaccurate or may not reflect your actual circumstances.
Laws, government programs, tax rules, financial markets, healthcare costs, and personal circumstances can change. LongClarity does not guarantee that assumptions, estimates, benefit calculations, tax calculations, or other modeled information will match future conditions or actual results.
Estimated Federal Tax, modeled Social Security benefits, Healthcare, the Modeled Medicare Coverage Start Age, required minimum distributions, and similar items are planning estimates rather than official determinations. A Modeled Medicare Coverage Start Age does not determine eligibility or enroll anyone in Medicare.
You should not rely on LongClarity as the sole source for determining eligibility for, or the actual amount or treatment of, a government benefit, tax obligation, required distribution, healthcare expense, or other financial obligation.
LongClarity provides projections to help you understand the potential effects of the information and assumptions used in the model. Those projections are estimates and are not guarantees of actual retirement outcomes.
4. LongClarity Coach and Scenario Exploration
LongClarity includes educational tools that help you explore how changes to retirement assumptions may affect modeled outcomes. These tools include LongClarity Coach, Coach Plays, Explore, and other scenario-modeling features.
LongClarity may automatically evaluate or compare multiple hypothetical scenarios based on your Current Plan, the information and assumptions you provide, and a goal or target you choose.
When LongClarity identifies scenarios that produce different modeled outcomes, those scenarios are presented for educational comparison and exploration. Their presentation does not mean that LongClarity recommends, endorses, or determines that a particular scenario or financial action is appropriate for you.
A scenario that produces a more favorable modeled result may involve tradeoffs or consequences that are not fully represented by the retirement model. You are responsible for evaluating whether any proposed change is appropriate for your circumstances.
LongClarity Coach does not independently know your complete financial, tax, legal, health, family, employment, or other personal circumstances beyond the information represented in the model.
Exploring or generating a scenario does not automatically modify your Current Plan. Changes become part of your Current Plan only when you deliberately review and adopt them.
5. Government Benefits, Taxes, Healthcare, and Similar Estimates
LongClarity may model or estimate information involving Social Security, taxes, Medicare or other healthcare costs, required minimum distributions, retirement accounts, and other matters affected by laws, regulations, government programs, or financial rules.
These calculations are provided as retirement-planning estimates. LongClarity is not the Social Security Administration, Internal Revenue Service, Centers for Medicare & Medicaid Services, or any other government agency, and LongClarity's estimates are not official determinations by those organizations.
LongClarity may use simplified modeling methods and assumptions rather than every rule, exception, election, tax provision, benefit provision, or individual circumstance that could affect an actual result.
Laws, regulations, benefit formulas, tax rules, healthcare programs, eligibility requirements, and other applicable rules may change over time. LongClarity does not guarantee that its modeling will reflect every future change or every rule applicable to your individual circumstances.
Before making a decision that depends on an actual benefit amount, eligibility determination, tax obligation, required distribution, healthcare cost, or similar matter, you should verify the relevant information with the appropriate official source or qualified professional.
6. Your Information and Responsibility for Your Plan
LongClarity creates retirement projections based substantially on the information, assumptions, and choices you provide or select.
You are responsible for reviewing the information in your LongClarity plan and for determining whether it reasonably reflects your household and the retirement scenario you want to explore.
LongClarity does not independently verify information you enter, including income, spending, assets, savings, Social Security estimates, pension information, healthcare assumptions, retirement timing, or other household and financial information.
You may use hypothetical information or assumptions to explore different scenarios. When you do so, the resulting projections should be understood as modeling of that hypothetical scenario rather than a projection based on your actual circumstances.
Your financial circumstances and expectations may change over time. You are responsible for updating your information and assumptions when you want LongClarity's model to reflect those changes.
You are also responsible for reviewing a Proposed Plan before adopting it as your Current Plan. LongClarity does not automatically determine whether an adopted change is appropriate for you simply because it produces a particular modeled outcome.
You remain responsible for any decisions you make based on or after using LongClarity.
7. LongClarity Premium and Subscriptions
LongClarity may offer certain features through a paid LongClarity Premium subscription.
Purchases Through Apple
LongClarity Premium subscriptions purchased through the iOS application are processed by Apple through the App Store and are subject to Apple's applicable payment and subscription terms.
LongClarity does not directly process your payment-card information for App Store purchases.
Subscription Price and Offers
The price, subscription period, and any introductory or promotional offer available to you will be displayed through the App Store before you complete a purchase.
Promotional or introductory pricing may be limited to eligible consumers and may differ from the standard renewal price.
Automatic Renewal
LongClarity Premium is an auto-renewable subscription. Unless canceled in accordance with Apple's subscription procedures, your subscription may automatically renew at the applicable renewal price shown by Apple.
Apple controls billing, renewal processing, and the mechanisms for managing or canceling an App Store subscription.
Managing or Canceling Your Subscription
You may manage or cancel your subscription through your Apple account's subscription-management features. Canceling generally prevents future renewal and does not necessarily end Premium access immediately; access may continue through the remainder of the applicable paid subscription period, subject to Apple's rules.
Restoring Premium Access
LongClarity may use Apple's StoreKit services to determine your current subscription entitlement and to restore eligible purchases or subscription access.
Refunds
App Store purchases, billing, cancellations, and refund requests are subject to Apple's applicable policies and procedures. LongClarity does not independently determine or guarantee eligibility for an App Store refund.
8. Backups, Reports, and Exported Information
LongClarity allows you to create backups, retirement reports, PDFs, and other documents containing information from your retirement plan.
These files may contain substantial personal and financial information. You are responsible for deciding whether, where, and with whom you save or share them.
LongClarity backup files are not password-encrypted by LongClarity. You should treat .longclaritybackup files as sensitive and protect them accordingly.
When you choose to export or share information, LongClarity may use Apple's system sharing functionality to allow you to select a destination.
Once information has been exported from LongClarity, the application, storage provider, device, service, or person you select may retain or further distribute that information. LongClarity cannot control, recall, or delete copies after they have been exported to a destination outside the app.
You are responsible for maintaining any backups you wish to preserve and for protecting access to exported LongClarity information.
LongClarity does not guarantee that a backup or exported file will remain compatible indefinitely with future versions of the application.
9. Software Operation, Errors, Updates, and Compatibility
LongClarity is primarily an on-device application. Core retirement-plan information and retirement-model calculations are stored and processed locally on your device and do not depend on a LongClarity retirement-plan server being continuously available.
Certain functions may require internet connectivity or services provided by Apple or other third parties, including subscription purchases or restoration, application updates, and certain sharing functions.
Like any software, LongClarity may experience bugs, calculation issues, compatibility problems, or other technical errors. We will make reasonable efforts to investigate and resolve issues as they arise, but LongClarity does not promise a particular response time, resolution time, service level, or correction schedule.
If LongClarity identifies an error that may affect retirement-model results, we may correct that error through an application update or other appropriate means. Corrections or changes to calculations, assumptions, or modeling methods may cause modeled results to change even when you have not changed your information or assumptions.
LongClarity may release updates that correct errors, improve the application, modify calculations or modeling methods, add or change features, address compatibility issues, or respond to changes in laws, government programs, financial rules, or technology.
Application updates may not be installed immediately on every device. Availability and installation of updates may also depend on Apple, App Store settings, device compatibility, operating-system requirements, and other factors outside LongClarity's control.
LongClarity does not guarantee compatibility with every past or future version of iOS, every Apple device, or every previous version of LongClarity.
Before significant application or operating-system changes, consumers should maintain appropriate backups of LongClarity information they wish to preserve.
10. Intellectual Property and Permitted Use
LongClarity and its software, design, user interface, graphics, branding, text, models, calculations, reports, educational content, LongClarity Coach content, and other application materials are owned by or licensed to LongClarity and are protected by applicable intellectual-property laws.
Subject to these Terms and Apple's applicable App Store terms, LongClarity grants you a limited, personal, non-exclusive, non-transferable right to use the application for your own lawful purposes.
You may use reports, PDFs, and other outputs that LongClarity allows you to generate for your own personal and household retirement-planning purposes, including sharing them with financial, tax, legal, insurance, or other professionals you choose to consult.
You may not copy, reproduce, distribute, sell, license, commercially exploit, reverse engineer, circumvent security or access controls, or otherwise misuse LongClarity except as permitted by applicable law.
LongClarity and related names, logos, branding, and product identifiers may not be used in a manner that falsely suggests endorsement, affiliation, or authorization by LongClarity.
11. Use at Your Own Risk; Disclaimer of Warranties
Your use of LongClarity and your reliance on its calculations, projections, estimates, scenarios, reports, LongClarity Coach features, and other outputs are at your own risk.
LongClarity is an educational retirement-modeling tool. Its outputs are based on information and assumptions provided or selected by you, together with LongClarity's modeling methods and assumptions. Projections are estimates of hypothetical future outcomes and are not guarantees of actual results.
You remain responsible for evaluating LongClarity's outputs and for any financial, retirement, investment, tax, legal, insurance, employment, spending, Social Security, healthcare, or other decisions you make after using the application.
LongClarity may contain errors, bugs, calculation issues, incomplete information, or other limitations. Although we intend to make reasonable efforts to maintain and improve LongClarity and address issues as they arise, we do not guarantee that the application or its outputs will always be accurate, complete, current, uninterrupted, compatible, or error-free.
To the fullest extent permitted by applicable law, LongClarity is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind except those that cannot lawfully be excluded.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Long Clarity LLC and its owners, members, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for losses, damages, costs, claims, or liabilities arising from or related to your use of, inability to use, or reliance on LongClarity, except to the extent such liability cannot lawfully be excluded or limited.
This limitation includes losses or damages arising from or relating to:
- retirement, financial, investment, tax, legal, insurance, employment, healthcare, Social Security, spending, saving, or other decisions made after using LongClarity;
- reliance on any projection, estimate, calculation, chart, report, scenario, Coach output, comparison, modeled outcome, or other information produced by LongClarity;
- inaccurate, incomplete, outdated, hypothetical, or otherwise incorrect information or assumptions entered or selected by you;
- differences between modeled results and actual future financial or retirement outcomes;
- investment performance, inflation, market conditions, interest rates, longevity, spending, healthcare costs, taxes, laws, regulations, government programs, Social Security, Medicare, required minimum distributions, pensions, or other circumstances that differ from assumptions used by the model;
- software bugs, calculation errors, omissions, interruptions, compatibility issues, delayed corrections, or other technical problems;
- changes resulting from application updates, operating-system updates, corrections, revised calculations, revised assumptions, or changes to LongClarity's modeling methods;
- loss, corruption, deletion, inability to restore, or incompatibility of locally stored information or backup files;
- backup files, PDFs, reports, or other information that you choose to export, save, transmit, or share;
- unauthorized access to information after you export or share it outside LongClarity;
- actions, failures, availability, security, or policies of Apple, storage providers, sharing destinations, or other third-party services outside LongClarity's control; and
- decisions, recommendations, advice, services, actions, or omissions of any financial professional or other third party with whom you choose to share or discuss LongClarity information.
LongClarity is not responsible for financial losses or unfavorable retirement outcomes merely because an actual result differs from a result modeled or displayed by LongClarity.
LongClarity does not assume responsibility for determining whether a modeled scenario, assumption, strategy, retirement age, Social Security timing choice, spending level, savings amount, or other financial decision is appropriate for your individual circumstances.
Educational Purpose and Independent Professional Review
LongClarity is provided for educational and informational retirement-modeling purposes. LongClarity does not provide a professional financial plan and is not a substitute for individualized financial, investment, tax, legal, insurance, or other professional advice.
LongClarity's projections, scenarios, comparisons, Coach outputs, reports, and other findings should be used to help you explore and better understand retirement possibilities—not as the sole basis for making significant financial or retirement decisions.
Before acting on findings or modeled outcomes provided by LongClarity, you should consider reviewing and validating the relevant information with an appropriately qualified financial advisor or other professional who can evaluate your individual circumstances.
LongClarity encourages consumers to use the application and its Retirement Modeling Report as a starting point for informed retirement-planning conversations with qualified professionals.
Any professional you consult is independent of LongClarity unless expressly stated otherwise, and LongClarity is not responsible for the advice, recommendations, actions, or services provided by that professional.
To the fullest extent permitted by applicable law, LongClarity will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost savings, lost investment value, lost opportunity, loss of data, or other financial losses arising from or related to your use of LongClarity, even if the possibility of such loss was known or reasonably foreseeable.
To the fullest extent permitted by applicable law, LongClarity's total aggregate liability arising out of or relating to LongClarity or these Terms will not exceed the greater of (a) the amount you paid for LongClarity during the twelve months immediately preceding the event giving rise to the claim or (b) $100.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Long Clarity LLC and its owners, members, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs and expenses arising from or related to:
- your unlawful or unauthorized use of LongClarity;
- your material violation of these Terms;
- your violation of another person's rights;
- information, materials, or content you provide, export, distribute, or share through or in connection with LongClarity in violation of applicable law or another person's rights; or
- your unauthorized commercial exploitation, reproduction, distribution, or misuse of LongClarity or its protected materials.
This provision does not require you to indemnify LongClarity for matters for which indemnification cannot lawfully be required.
14. Suspension and Termination
You may stop using LongClarity at any time.
LongClarity may suspend or restrict access to features when reasonably necessary to protect the application, enforce these Terms, comply with applicable law, address fraud or misuse, protect LongClarity or others, or respond to circumstances outside LongClarity's reasonable control.
We may terminate or restrict your right to use LongClarity if you materially violate these Terms or use the application unlawfully or in a manner that materially harms LongClarity, its systems, intellectual property, other consumers, or third parties.
Because LongClarity does not maintain a consumer account system for retirement plans, deleting the application from your device is generally how you stop using LongClarity and remove its live local application data from that installation, subject to the separate limitations concerning Apple backups and information you previously exported.
Termination of your use of LongClarity does not automatically cancel an App Store subscription. App Store subscriptions must be managed or canceled through Apple's applicable subscription-management process.
Provisions of these Terms that by their nature should continue after you stop using LongClarity—including provisions concerning intellectual property, disclaimers, limitations of liability, and other applicable legal obligations—may survive termination.
15. Third-Party Services
LongClarity uses or interacts with certain services provided by third parties.
Apple Services
Apple provides the App Store, StoreKit, iOS, device and iCloud backup services, system sharing functionality, and other platform services that may be used in connection with LongClarity.
LongClarity does not control Apple's services, systems, policies, availability, account management, payment processing, subscription processing, device backups, or other operations. Your use of Apple services is also subject to Apple's applicable terms and policies.
Services You Choose
When you choose to export or share a LongClarity backup, retirement report, PDF, or other information, you may select a third-party application, storage provider, service, device, or person as the destination.
Once information is provided to a destination you select, that destination's own terms, privacy practices, security, availability, and other policies may apply.
LongClarity does not control third-party services and cannot guarantee their availability, security, performance, continued operation, or handling of information.
Nothing in these Terms makes LongClarity responsible for the independent acts or omissions of a third party except to the extent responsibility cannot legally be excluded.
Changes to Service Providers
LongClarity may change the third-party service providers it uses as the application evolves. If LongClarity materially changes what information it collects, transmits, or uses, its Privacy Policy and applicable disclosures will be updated as appropriate.
16. Governing Law and Dispute Resolution
Before filing a claim relating to LongClarity, you and Long Clarity LLC agree to make a good-faith effort to resolve the dispute informally. A notice of dispute should describe the issue, the requested resolution, and information reasonably sufficient to identify the affected transaction or app experience. The receiving party will have thirty days after receiving the notice to respond before either party files a lawsuit, unless a filing is necessary to preserve a claim or seek urgent relief.
These Terms and any dispute relating to LongClarity are governed by Ohio law, without regard to conflict-of-law rules, except to the extent federal law or another law that cannot validly be waived applies.
Except for a claim eligible to be brought in small-claims court, and except where applicable law gives you a nonwaivable right to use another forum, you and Long Clarity LLC consent to the exclusive jurisdiction of the state and federal courts serving Warren County, Ohio.
Nothing in these Terms is intended to eliminate rights or remedies that cannot legally be waived under applicable law.
17. Changes to These Terms
LongClarity may update these Terms as the application, its features, business practices, or applicable legal requirements change.
When these Terms are updated, the Last Updated date will be revised.
If a change materially affects your rights or obligations, LongClarity may provide additional notice through the application or another appropriate method.
Your continued use of LongClarity after updated Terms become effective may constitute acceptance of the updated Terms to the extent permitted by applicable law.
If applicable law requires a different form of notice or affirmative consent for a particular change, LongClarity will use the legally required process.
18. Apple App Store
These Terms are between you and Long Clarity LLC, not Apple. Long Clarity LLC, not Apple, is responsible for LongClarity and its content. LongClarity is licensed, not sold, and your license is limited to a personal, non-transferable right to use LongClarity on Apple-branded products that you own or control as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules, including permitted Family Sharing or volume-purchase access.
Long Clarity LLC is responsible for maintenance and support for LongClarity as required by applicable law. Apple has no obligation to provide maintenance or support. Long Clarity LLC, not Apple, is responsible for addressing claims concerning LongClarity, including product-liability, legal or regulatory compliance, consumer-protection, privacy, and intellectual-property claims.
If LongClarity fails to conform to an applicable warranty that cannot lawfully be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, under Apple's applicable policies. To the maximum extent permitted by law, Apple has no other warranty obligation regarding LongClarity.
You must comply with applicable third-party terms when using LongClarity. You represent that you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism and are not listed on a U.S. government prohibited- or restricted-party list.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you after you accept these Terms.
19. General Terms
These Terms, the LongClarity Privacy Policy, and any additional terms presented for a particular feature constitute the entire agreement between you and Long Clarity LLC concerning LongClarity, subject to Apple's applicable terms. If an additional term conflicts with these Terms, the additional term controls only for the feature to which it applies.
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without Long Clarity LLC's prior written consent. Long Clarity LLC may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law, subject to applicable law and any required notice.
Long Clarity LLC is not responsible for delay or failure caused by events beyond its reasonable control, including failures of Apple services, communications networks, devices, operating systems, utilities, natural events, governmental actions, labor disputes, or security incidents, except to the extent responsibility cannot legally be excluded.
Section titles are provided for convenience and do not affect interpretation. The words “including” and “includes” mean “including without limitation.” Electronic notices and records may be provided through LongClarity or another legally permitted method.
